User Accounts and Registration

Property management involves inherent risks including market fluctuations, property damage, and guest-related issues. We cannot guarantee specific financial outcomes or property performance.
Limitation of Liability
General Limitation
To the maximum extent permitted by law, Duvoire shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use.
Maximum Liability
Our total liability to you for any claims arising from or related to these Terms or our Services shall not exceed the amount you paid us in the 12 months preceding the claim.
Essential Purpose
The limitations in this section are fundamental to the agreement between you and Duvoire and would be agreed to even if the exclusive remedies failed of their essential purpose.
Important: Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless Duvoire and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:
- Your use of our Services
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit or transmit through our Services
- Your violation of applicable laws or regulations
This indemnification obligation will survive the termination of these Terms and your use of our Services.
Dispute Resolution
Informal Resolution
Before pursuing formal dispute resolution, both parties agree to attempt to resolve disputes informally through good faith negotiations for at least 30 days.
Arbitration
Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
Venue and Law
Arbitration shall take place in Reno, Nevada, and shall be governed by the laws of the State of Nevada, without regard to conflict of law principles.
Class Action Waiver
You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.
Termination
Termination by You
You may terminate your use of our Services at any time by providing written notice. Termination will be effective upon our receipt of your notice.
Termination by Us
We may terminate or suspend your access to our Services immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or our business.
Effect of Termination
Upon termination, your right to use our Services will cease immediately. Provisions of these Terms that by their nature should survive termination shall remain in effect.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions.
Any legal action or proceeding relating to these Terms or our Services shall be instituted in the state or federal courts located in Washoe County, Nevada. You agree to submit to the personal jurisdiction of these courts.
Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by:
